Algemene bepalingen behorend bij de behandelingsovereenkomst tussen de therapeut van Iokai shiatsu - Charlotte Lafitte en de cliënt / de cliënten.
1. Indien cliënt na het eerste kennismakingsgesprek een nieuwe datum heeft afgesproken voor een vervolggesprek, is er sprake van een behandelingsovereenkomst. Deze behandelingsovereenkomst wordt op schrift vastgelegd.
2. De behandelingsovereenkomst is tweeledig;
a. De therapeut en de cliënt gaan een relatie met elkaar aan voor een bepaalde periode in de verhouding therapeut – cliënt.
b. De behandeling heeft betrekking op de door de cliënt aangedragen hulpvraag en behandeldoelen. Deze kunnen lopende het traject worden bijgesteld, c.q. gespecificeerd.
3. De overeenkomst kan op de volgende manieren of door de volgende omstandigheden worden beëindigd:

Therapeut en cliënt bepalen in gezamenlijk overleg dat er geen sessies meer nodig zijn;

Cliënt geeft aan, mondeling, schriftelijk of via e-mail dat men geen sessies meer wil afspreken;

De therapeut geeft aan, mondeling, schriftelijk of via e-mail geen sessies meer te zullen geven.

Cliënt houdt zich herhaaldelijk niet aan de algemene bepalingen uit deze behandelings-overeenkomst of aan afspraken die gedurende de sessies zijn gemaakt tussen cliënt en de therapeut;

De therapeut is van mening dat in verband met de problematiek van de cliënt en de competentie van de therapeut, de therapeut niet bekwaam is om de cliënt te begeleiden. Dit is in ieder geval aan de orde als de problematiek direct verband houdt met contra-indicaties.
4. De overeenkomst eindigt van rechtswege indien er geen sessie afgesproken is voor een termijn van langer dan drie maanden na de laatst gehouden sessie, tenzij uitdrukkelijk anders afgesproken tussen therapeut en cliënt.
5. Bij het aangaan van de overeenkomst wordt voor een te houden sessie een bedrag per sessie afgesproken.
6. Betalingswijze van de behandelingen is online (Ideal op credit card), op tikkie, rekening of contant per consult. Betaling geschiedt binnen 14 dagen op rekening NL46 ABNA 0838 6467 94 onder vermelding van factuurnummer.
7. Indien sprake is van het bepaalde in lid 4 wordt bij een nieuwe afspraak een nieuwe overeenkomst van kracht met mogelijk een ander uurtarief.
8. Indien verhinderd dient een afgesproken sessie 48 uur / twee werkdagen van te voren te worden afgemeld. De therapeut brengt de kosten voor deze gemiste sessie in rekening indien de cliënt zich niet tijdig heeft afgemeld, ongeacht de reden voor afmelding. Dit geldt ook als de cliënt, om welke reden dan ook, niet komt op afgesproken tijd en dag.

De therapeut houdt een dossier bij van aantekeningen van de gehouden sessies en andere relevante documenten, dat op diens verzoek door de cliënt kan worden ingezien. Het dossier (of een deel daarvan) wordt dan gekopieerd. Dit is kosteloos (met uitzondering van buitensporige verzoeken). Per 1 januari 2020 wordt het dossier conform de wettelijke bewaartermijn in totaal 20 jaar bewaard. Verder bestaat er inzagerecht voor nabestaanden. Voor wat betreft de informatieplicht van de hulpverlener is er aan aanvulling, t.w.: het zwaartepunt komt te liggen op het “samen” beslissen over de behandeling met de patiënt/cliënt.
10. De therapeut houdt zich aan geheimhoudingsplicht. Gegevens van de cliënt worden alleen met diens uitdrukkelijke goedkeuring aan derden (artsen en andere therapeuten) overhandigd of medegedeeld.
11. Indien cliënt, diens huisarts of andere behandelaar een schriftelijke rapportage verlangt van het gehouden behandelingstraject met cliënt, wordt hiervoor een factuur gestuurd aan cliënt. Deze factuur behelst maximaal een uur arbeid tegen het in de overeenkomst met de cliënt afgesproken uurtarief.
12. De therapeut is aangesloten bij de beroepsorganisatie Shiatsu Vereniging Nederlands. De regels van deze beroepsorganisatie zijn op de therapeut van toepassing. De cliënt kan zich met klachten over de therapeut bij deze beroepsorganisatie melden (contactpersoon@shiatsuvereniging.nl ). De therapeut is daarnaast geregistreerd in het HBO Register Beroepsbeoefenaren Complementaire Zorg (RBCZ).
13. Cliënt gedraagt zich als een gast; hij/ zij houdt zich aan de regels van de gastvrouw/gastheer (de therapeut). Er wordt tijdens een sessie niet gerookt en geen alcohol gedronken. De kosten van vernieling van eigendommen van de therapeut door de cliënt, zullen op cliënt worden verhaald. Van iedere vorm van mishandeling van de therapeut door de cliënt zal te allen tijde aangifte bij de politie worden gedaan.
14. Charlotte Lafitte is niet aansprakelijk voor eventuele nadelige gevolgen die zijn ontstaan doordat cliënt onjuiste of onvolledige informatie heeft verstrekt, dan wel doordat cliënt voor hem/haar bekende en beschikbare informatie aanwezig in medische dossiers van arts/specialist of andere behandelaar, niet heeft verstrekt.
15. De cliënt heeft het privacyreglement van praktijk Iokai shiatsu - Charlotte Lafitte gelezen welke vermeld staat op de website van praktijk en cliënt stemt in met dit privacyreglement.
16. Charlotte Lafitte is niet aansprakelijk voor schade die is ontstaan aan eigendommen van cliënt door parkeren op of het betreden van het terrein aan de Harpstraat 32 - 3513XC Utrecht , noch voor andere schade ontstaan door Het betreden van de praktijk, de hal en het gebruik maken van het toilet.

General Terms and Conditions applicable to the treatment agreement between the therapist of Iokai Shiatsu – Charlotte Lafitte and the client / clients
1. If, after the initial introductory consultation, the client schedules a new appointment for a follow-up session, a treatment agreement comes into effect. This treatment agreement is recorded in writing.
2. The treatment agreement consists of two parts:
a. The therapist and the client enter into a professional relationship with each other for a certain period in the therapist–client capacity.
b. The treatment relates to the client’s request for assistance and treatment goals. These may be adjusted or further specified during the course of the treatment process.
3. The agreement may be terminated in the following ways or under the following circumstances:

The therapist and client mutually decide that no further sessions are necessary;

The client indicates verbally, in writing, or by email that they no longer wish to schedule sessions;

The therapist indicates verbally, in writing, or by email that no further sessions will be provided;

The client repeatedly fails to comply with the general provisions of this treatment agreement or with agreements made during the sessions between client and therapist;
-
The therapist believes that, in relation to the client’s issues and the therapist’s professional competence, the therapist is not qualified to guide the client. This applies in any case where the issues are directly related to contraindications.
4.The agreement automatically ends if no session has been scheduled for a period longer than three months after the last session, unless explicitly agreed otherwise between therapist and client.
5.Upon entering into the agreement, a fee per session is agreed upon. This fee is included in the treatment agreement.
6. Payment method for the treatments is online (Ideal or credit card), tikkie, on account or cash per consultation. Payment is made within 14 days on account NL46 ABNA 0838 6467 94, stating invoice number.
7. If the situation described in provision 4 applies, a new agreement will come into effect for any new appointment, possibly with a different hourly rate.
8. If the client is unable to attend, a scheduled session must be cancelled at least 48 hours / two working days in advance. The therapist will charge the costs of the missed session if the client has not cancelled in time, regardless of the reason for cancellation. This also applies if the client does not appear at the agreed date and time for any reason.

The therapist keeps a file containing notes of the sessions held and other relevant documents, which the client may inspect upon request. The file (or part of it) will then be copied. This is free of charge, except in the case of excessive requests. As of 1 January 2020, the file is retained for a total of 20 years in accordance with the statutory retention period. Surviving relatives also have the right to access the file. Regarding the therapist’s duty to inform, an important addition applies: the emphasis is placed on jointly deciding on the treatment together with the patient/client.
10. The therapist observes a duty of confidentiality. Client information will only be shared with third parties (doctors or other therapists) with the client’s explicit consent.
11. If the client, their general practitioner, or another healthcare provider requests a written report of the treatment process, the client will receive an invoice for this service. This invoice covers a maximum of one hour of work at the hourly rate agreed upon in the treatment agreement.
12. The therapist is affiliated with the professional association Shiatsu Vereniging Nederland. The regulations of this professional association apply to the therapist. The client may submit complaints about the therapist to this professional association (contactpersoon@shiatsuvereniging.nl). The therapist is also registered with the HBO Register for Complementary Healthcare Professionals (RBCZ).
13.The client shall behave as a guest and comply with the house rules of the host/hostess (the therapist). Smoking and alcohol consumption are not permitted during sessions. The costs of damage to the therapist’s property caused by the client will be charged to the client. Any form of abuse or assault towards the therapist by the client will always be reported to the police.
14. Iokai Shiatsu – Charlotte Lafitte is not liable for any adverse consequences arising from incorrect or incomplete information provided by the client, or from the client’s failure to provide information known and available to them in medical records from a doctor, specialist, or other healthcare provider.
15. The client has read the privacy policy of Iokai Shiatsu – Charlotte Lafitte, as stated on the practice website, and agrees to this privacy policy.
16. Charlotte Lafitte is not liable for damage to the client’s property resulting from parking on or entering the premises at Harpstraat 32, 3513 XC Utrecht, nor for any other damage arising from entering the practice, the hallway, or using the toilet facilities.
